Win One for Bodog!
1st Technology LLC got bad news last Wednesday. In their court established case in opposition to Bodog Entertainment and Calvin Ayre, the federal judge overseeing the case made it clear that Technology’s contempt motion filed against Calvin Ayre for not arriving in the Las Vegas Court, for a Nevada Court Examination.
Bodog filed a motion in defense of their decision, which clarified the fact that Bodog Entertainment Group, SA is not a business based in Nevada, and Calvin Ayre, the founder and owner has not been a resident there of, thus neither need to be required to be subject to court examination as is described by Nevada Law. The Federal Judge agreed with the motion filed by Calvin Ayre, and told 1st Technology that their contempt motion was not valid.
In response to the court’s ruling, Calvin Ayre, who has been very vocal through out this ordeal, said in a public release “This has been an interesting case, and as it progresses, there seems to be plenty of compelling facts emerging. With the recent ruling in favor of the defense, I’m happy that it was also clarified by the judge that I am, by law, not personally in contempt of any order from the Nevada court.”
Remember this case is the first in what maybe a long line of cases against the online poker rooms. Of course it is the first because of a vendetta but none the less, a first.
